Four Counts Weren’t Enough? Peter Nonyane aka Gagash & Tibane Face a New Court Twist
Peter Nonyane aka Gagash and Charlotte Tibane returned to the Polokwane Magistrates’ Court on 21 August 2026 for a formal bail application — but the proceedings took an unexpected turn when the State amended the charge sheet.
The State confirmed that the accused had previously faced four charges: two counts of fraud and two counts of money laundering. During today's proceedings, the State applied to add Count 5, described as an additional fraud charge involving Charlotte Tibane.
The new allegation centres on the estate of the late Thompson Maswanganyi, with Yolanda Shongile Maswanganyi named in the charge. The State alleges that Tibane was appointed to assist with the administration of the deceased estate.
At the centre of the new allegation is R2,775,762.03. The State alleges that this money was transferred, retained or dealt with for purposes other than payments to beneficiaries, creditors or heirs.
The State also read an alternative theft allegation relating to the same R2.775 million amount, alleging that the money was unlawfully and intentionally taken from the estate with the intention of permanently depriving the relevant persons of the property.

The proceedings therefore introduced a major new element into the case: four existing charges have now been joined by a fifth count, with the Maswanganyi estate and R2.775 million at the centre of the new allegation.
The bail application itself is being contested. The State told the court that it is opposing the release of the accused, while the defence is seeking bail. The matter is treated as a Schedule 5 offence, meaning the accused must satisfy the court that the interests of justice permit their release.
Charlotte Tibane's bail affidavit also puts forward her personal circumstances, including her legal practice, children, family responsibilities and proposed bail conditions. She maintains that she intends to plead not guilty and says she has been aware of the investigation since November 2024.
Peter Nonyane aka Gagash is Accused No. 2, while Charlotte Tibane is Accused No. 1.
