On July 17, 2025, deputies in Florida contacted a woman sitting in the driver's seat of a parked car in a restaurant parking lot. She insisted she was only sitting in her car and was not driving. The deputy answered that this was not the end of the legal question. What followed was a six-minute standoff over one driver's license, repeated explanations of Florida's actual physical control standard, and a refusal that ended with the woman removed from the car and handcuffed. Legal Analysis Includes: Florida's actual physical control standard under Fla. Stat. 316.193, the standard jury instruction, and State v. Fitzgerald The duty to present a license under Fla. Stat. 322.15 and the word "operating" Resisting an officer without violence under Fla. Stat. 843.02 (N.H. v. State, P.B. v. State, T.D. v. State) Warrantless misdemeanor DUI arrests under Steiner v.
