The debate between the right to protest and the maintenance of public order has once again come into focus following restrictions on protests in Delhi. The issue raises important questions about the right to peaceful assembly, preventive policing, constitutional freedoms and the Supreme Court’s proportionality test.
In this video, we explain the constitutional and legal framework governing protests in India, the powers of police to impose restrictions, and the balance between citizens’ fundamental rights and public order. We also examine the role of the Supreme Court in determining whether restrictions on peaceful demonstrations are reasonable, necessary and proportionate.
This topic is important for understanding Article 19(1)(a), Article 19(1)(b), reasonable restrictions under Article 19(2) and Article 19(3), preventive policing, Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), and the constitutional principles governing freedom of assembly.
This topic is highly relevant for MPPSC Prelims 2027, MPPSC Mains, Madhya Pradesh GK, Indian Polity, Fundamental Rights, Constitutional Law, Supreme Court Judgments and Current Affairs 2026.
