The court had a difficult decision to make in the case of Bailey Damansky. Despite completing most of her required services and showing remorse, her parenting time with the children remains suspended after she entered a plea/agreement involving second-degree child abuse.
During this CPS review and permanency-planning hearing, the Guardian ad Litem expressed serious reservations about ever recommending full reunification, specifically pointing to the nature of the injuries sustained by one of the children.
The caseworker acknowledged Bailey’s substantial progress and said supervised visits had previously gone well, with the children appearing happy and receptive to seeing their mother. But the biggest obstacle remains the pending criminal sentencing—and the uncertainty surrounding what happens next.
The judge ultimately kept the suspension of parenting time in place for both parents, kept the children in their current placements, and found that a significant risk of harm remains associated with returning the children to Bailey’s care.
The permanency goal remains reunification, with adoption as a concurrent goal. The court scheduled the next review for September 5 at 10:00 a.m., while the parties await the outcome of Bailey’s criminal sentencing and further professional recommendations.
One of the most striking moments came when the GAL said she was unsure whether she could ever recommend full reunification because of “the types of injuries that were sustained by this child.”
LEGAL CONTEXT:
In child-welfare and permanency proceedings, courts generally consider the safety and best interests of the children when determining whether children can safely return home. Parenting-time restrictions may remain in place when the court finds continuing safety concerns or a significant risk of harm. The specific standards and procedures vary by jurisdiction.
