On May 3, 2023, Athens-Clarke County police officers responded to a Synovus Bank in Athens, Georgia, after bank staff intercepted a woman attempting to cash a counterfeit cashier's check. The woman claimed she earned the check working a three-week gig at a Monster Jam festival through the GigSmart app. However, she could not name a single supervisor, had no tax documents, and when officers asked her to open the app, the job did not exist in her work history. ⚖️ STATUTES & LANDMARK CASE LAW ANALYZED: • O.C.G.A. Section 16-9-1(e) & 16-9-2(d) (Forgery in the Fourth Degree): Possessing, uttering, or delivering a forged check with intent to defraud is a misdemeanor punishable by up to 12 months in jail for a first or second offense. • Betts v. State, 327 Ga. App. 613 (2014): Holds that the prosecution must establish beyond a reasonable doubt that the defendant knowingly possessed or presented a forged instrument. • Taylor v. State, 293 Ga. App. 551 (2008) & Jordan v. State, 242 Ga. App. 547 (2000): Establish that a jury may infer guilty knowledge and intent to defraud from implausible, unverifiable employment claims and no link to the account holder. • Berkemer v. McCarty, 468 U.S. 420 (1984): Confirms that non-custodial investigative questioning during a parking-lot detention does not require Miranda warnings prior to formal arrest. 🔔 SUBSCRIBE & JOIN THE DISCUSSION: What is your legal take on how officers handled this encounter?
