A (R.A) regular first appeal is a legal right that allows a party to appeal a decree passed by a court that has original jurisdiction. The appeal can be filed under Section 96 of the Code of Civil Procedure (CPC), unless there is an express prohibition. The appeal is an opportunity for the party to be heard on questions of law and fact, and the judgment must address all issues and provide reasons for its findings.
The following parties may appeal:
A party to the suit who was adversely affected by the decree
The legal representatives of a party who was adversely affected by the decree, if the party is deceased
A transferee of the party's interest, if their name is on the suit's record and they are bound by the decree
An auction purchaser who can appeal an order that sets aside a sale due to fraud
In some cases, an appeal may not be maintainable, such as when the decree was passed by the court with the consent of the parties. If the suit property is valued at more than Rs. 25 lacs, the first appeal must be filed before the High Court.
File a petition
The appellant or their pleader must submit a written petition for the appeal. The petition should include a copy of the judgment or order being appealed against, unless the court directs otherwise.
Meet the time limit
There is a time limit for filing an appeal, which varies depending on the type of appeal. For example, in civil suits, the time limit is 90 days for appeals to the High Court and 30 days for appeals to other courts.
Attend the hearing
The hearing is a key part of the appeal process and includes oral arguments, evidence examination, and the delivery of a judgment.
Consider the decision
The higher forum can confirm, reverse, or modify the decision of the lower forum. They can also send the case back to the lower forum for a new decision.
Appeals are usually based on alleged errors in the trial's procedure or the judge's interpretation of the law. They are not mandatory, and filing an appeal does not automatically stay the lower court's order or decree. However, the appellate court can order a stay of execution if they deem it necessary
