What Massachusetts probate actually costs, in months and in categories of expense — across all three probate tracks. VISIT THE BLOG: https://botelholawgroup.com/what-prob... And the reason even a simple, well-organised estate usually takes about a year to close. Everyone says probate is slow and expensive. Very few people explain what that means in Massachusetts specifically, and the honest answer depends entirely on which of the three tracks an estate lands on. Voluntary administration handles small estates of personal property worth $25,000 or less, excluding the value of a car, with no real estate — measured in weeks. Informal probate is handled by a magistrate without a hearing and the appointment can happen within days, but being appointed is not the same as being finished. Formal probate involves a judge and a hearing and takes longest. I explain why even a straightforward estate generally takes the better part of a year: Massachusetts allows creditors a window of roughly one year from the date of death to bring claims, and a responsible personal representative does not distribute before it closes. I also cover the Massachusetts estate tax lien that attaches to real property and must be released before a sale can close. On cost, I give the categories rather than a headline number — filing fees that differ by track, publication, bond, appraisal, accounting, and attorney's fees — and point you to the court's published fee schedule for current figures. Then the two costs nobody invoices: probate is a public record, and someone in your family has to do all of this in the year after a death.
