In today’s video, I am sharing an extremely important Supreme Court development related to Dearness Allowance (DA) arrears—a matter that has the potential to become as historic as the landmark 1982 Supreme Court pension judgment (which is still cited in pension-related cases even today). This time, the issue is not about pension—this is about DA and DA arrears, and the Supreme Court has already reserved its judgment after completing the hearing. This means the arguments are over, the matter is concluded, and the final order can come any moment. Why is this case so important? Because both sides have treated it as a high-stakes national issue: The employees’ side has hired 32 advocates, including very senior and well-known counsels. The Government side has hired 54 advocates. This clearly shows how critical the outcome is—not only for employees, but also for the Government. The employees have collectively contributed to fight this case because it is directly connected to their dignity, rightful pay protection, and fair compensation through DA. What is the actual dispute? From 2009 onwards for several years, the West Bengal Government did not pay DA to its employees at the level granted as per Central Government patterns. Employees argued that DA is not a “wish” of any government—it is linked to inflation and is connected to a dignified life and fairness in service benefits. They approached the legal route step-by-step: Administrative Tribunal Calcutta High Court Supreme Court (after the State filed SLP) The Calcutta High Court reportedly ruled in favour of employees (that DA must be paid), after which the State Government moved to the Supreme Court. The Supreme Court has completed the hearing, and the judgment is now reserved. Major development already done As shared in the video, the Supreme Court has already ordered payment of 25% of DA arrears (as per the case progress). Now, the biggest decision is pending on the remaining 75% and on the wider principle involved. Why this could impact crores of employees & pensioners If the final verdict comes in favour of employees, it can set a strong precedent for DA as a right-based benefit linked to inflation—meaning governments in future may not be able to delay or deny DA arbitrarily. Most importantly, it can open the door for a bigger national issue: The 18-month DA/DR freeze during COVID period (where DA/DR was not paid) could get a stronger legal pathway if the Supreme Court establishes the principle that DA cannot be withheld unfairly. Current status (as per this update) The judgment has been reserved (arguments concluded). The case has been under deliberation since around 8 September 2025 (reserved for judgment). The final order can be announced any time—before the Winter Session begins or even after it ends. Friends, this is a crucial welfare update.
