The Licence Clause That Vizio Wrote and Ignored

   / @thehambergerreport   Software Freedom Conservancy has sued Vizio in Orange County Superior Court for selling General Public License covered smart televisions since 2018 without ever delivering source code that compiles, despite six separate 2019 delivery attempts. Two rulings, in December 2023 and December 2025, have narrowed but not resolved the case's central question: whether an ordinary purchaser, not just a copyright holder, has standing as a third party beneficiary to enforce the licence. A jury, not a judge, is now deciding that question, in a case that also touches how open weight artificial intelligence licences might one day be enforced by the people who use them, not just the companies that built them.
