Supreme Court Questions Delay In TMC MPs’ Disqualification Case The Supreme Court questioned whether the Lok Sabha Speaker’s delay in deciding disqualification petitions against 20 TMC MPs is consistent with the Court’s earlier directions. Senior Advocate Kalyan Bandopadhyay asked: *“Are the observations of this Court being respected by another constitutional authority—the Speaker?”* The case concerns 20 TMC MPs facing disqualification petitions. The Speaker had issued notices on August 5, but even after the initial 14-day period and an extension until September 22, no replies had been filed. Another extension has now been sought. Justice Joymalya Bagchi pointed out that the three-month period referred to by the Supreme Court in Keisham Meghachandra Singh had already lapsed. CJI Suryakant observed: *“There is a presumption that a constitutional authority does not need to be reminded, but that presumption is rebuttable.”* Justice Bagchi also described the Speaker’s role as *“amphibious”* — combining the functions of the head of the legislative wing with an adjudicatory function. The Solicitor General, Tushar Mehta, opposed the idea of the Court setting a timeline for the Speaker, while the Court decided to keep the petition alive and seek a proposed timeline.
