Major changes to the UK settlement system are causing concern among migrants as the government moves toward a new Earned Settlement model. Under the framework announced on 2 November 2026, the normal starting point for settlement will increase from 5 years to 10 years for many migrants. However, people may qualify sooner depending on factors such as earnings, public-service contribution, immigration compliance and other requirements. There is important relief for qualifying social care workers. Those who entered or switched into the relevant route before the May 2025 Immigration White Paper, complied with their visa conditions and earned at least £25,000 a year in social care can remain on an existing five-year route to settlement. Care workers who do not meet those conditions may be offered another five-year care visa before becoming eligible to apply for settlement. Similar transitional arrangements are planned for certain healthcare and education workers. For many other migrants, the new 10-year baseline could apply unless they qualify for an accelerated route. The government says people earning more than £50,271, as well as some doctors, nurses and teachers, may qualify after five years, while the highest earners could potentially settle after three years. Applicants will also face mandatory requirements involving criminality, English-language ability, government debt and sustained National Insurance contributions. The government has confirmed that further technical guidance will be published before full implementation. Watch the full discussion for a clear breakdown of the 5-year, 10-year and longer ILR routes, who may benefit from transitional protections and what the changes could mean for Skilled Workers, care workers and other visa holders already living in Britain.
