Separation Period: The couple must have been living separately for at least one year before filing the petition. First Motion Petition: A joint petition is filed in the family court by both parties expressing their consent to divorce. Cooling-Off Period: After filing the first petition, there is a minimum six-month waiting period (can be waived in some cases) before the second motion can be filed. After the cooling-off period, if both parties still agree, they appear before the court again to confirm the divorce request. Final Decree: If the court is satisfied that the mutual consent is genuine and no force or fraud is involved, it grants a decree of divorce. Section 13B is often chosen for an amicable and less time-consuming divorce process compared to contested divorce proceedings.
