Starting November 8, every New York State employer, regardless of size, must give current and former employees a copy of their personnel records within five business days of a written request.
This presentation with GTM HR Consultant Heidi Gross covers what the law requires and how to get ready.
Employees can request their records, dispute what’s in them, and receive notice within 10 days whenever negative information is added. The law also extends beyond the HR file to records managers and outside vendors keep.
You'll learn:
What counts as a personnel record, and what doesn’t
Who can request records, how often, and how quickly you must respond
How to handle disputed information and employee rebuttals
Where covered records may be kept outside HR
Retention rules, anti-retaliation protections, and penalties
What the expected 2027 amendments may change, and why you should comply now
Best practices for setting up a request and response process
Heidi Gross brings more than 26 years of HR leadership experience and advises employers on regulatory compliance, employee relations, and talent strategy.
