Accused number three Mthobisi Mncube agrees he is short, and that on 26 October 2014 he had dreadlocks and wore a jacket. On 29 October 2026, he told the Pretoria High Court that the people inside the Khumalo house were describing someone else.
Prosecutor Ronnie Sibanda read out the evidence of Tumelo Madlala, Mthokoziseni Thwala and Zandile Khumalo about the short intruder with dreadlocks who carried a firearm. The record described dreadlocks just below the ear and a complexion one witness compared to "coffee with milk". Mncube says he is "over light" and that his dreadlocks went down his back. "It is the police that alleged that it was me, not the people that were inside the house," he said.
The state put it to him that the bullet recovered from the scene came from a 9mm pistol. Mncube says the witnesses saw a .38 revolver and that no cartridges were found in the house, which he says fits a revolver and not a pistol. He also disputed the evidence of Constable Sizwe Zungu, saying his phone was picking up towers in town at the time. The state pointed out that his phone recorded no activity after 20:32 that night, which Mncube accepted. "That one beats you hands down," he told the prosecutor.
On the ballistics evidence of Lieutenant Colonel Christian Mangena, Mncube said he was being made a sacrificial lamb. "We are not Jesus," he said. "Each and every person has got to carry his or her own sins."
The cross-examination continues.
