⚖️ When you dispute a tax debt, do you still have to pay SARS? 💰
In this training session, we unpack the High Court judgment in Mboneni Benedicta Maumela v Commissioner for the South African Revenue Service and its important implications for the “pay now, argue later” principle under South African tax law. 🇿🇦
The session takes a closer look at:
💰 Section 164 of the Tax Administration Act and the suspension of payment of disputed tax debt
⚖️ The scope of SARS’ discretion when considering a request to suspend payment
⏳ The role of urgent court proceedings where a taxpayer faces enforcement while a dispute is ongoing
📑 What happens when SARS withdraws an administrative decision after litigation has already commenced
🏛️ The principles governing ordinary and punitive costs orders
💼 When an attorney-and-client costs order may—or may not—be justified
🔎 Importantly, the Court found that while the taxpayer was justified in approaching the Court on an urgent basis, SARS’ subsequent withdrawal of its decision did not amount to misconduct sufficient to justify a punitive attorney-and-client costs order.
