The stepson who was out in the snow with the boys that afternoon takes the stand for the State. What did the guardian tell him to do, and who decided the rest? This is Damian Hauschultz's full testimony, sworn to released, from Day 2 of the Buried Beneath the Snow Trial in Manitowoc County, Wisconsin. Ethan Hauschultz was 7 years old when he lost his life in April 2018. The State says it followed a punishment: carrying a log back and forth through wet snow for about two hours. Timothy Hauschultz, Ethan's great-uncle and court-appointed guardian, faces six charges, including child neglect with death as the consequence. He pleaded not guilty and he is presumed innocent. Damian, the defendant's stepson, was 14 at the time and was home with the boys that day. He is already convicted in adult court for his own part, and the State called him to tell the jury what the guardian told him to do. Watch who he says made the calls. Asked how long the boys would carry wood, he tells the State, "It was also Tim who decided that." Asked about the logs, "Initially it was up to the kids to pick one." Then the State walks him through two phone calls to the guardian that afternoon and the wait for him to get home. After lunch the defense takes over, and Attorney Donna Kuchler asks him what the guardian actually said. Listen for "The only thing he told me was to go out there with them." Then the prosecutor comes back on redirect and asks who had the final say on the logs. Both sides leave with something from the same witness. The State has the length of the punishment, the logs and the order to keep the boys out there. The defense has a clear "Correct." when asked if he was ever told to hurt the children. So here is my question. When an adult sets a punishment and leaves a teenager in charge of it, where does the order end and the choice begin? That is what this jury has to decide. I give my read at the end, on the scale. Watch it all first and make your own call. We are not the jury; only the jurors decide. --- WATCH WITH JUSTICE 0:00 What this video is, and a preview 0:18 Video starts: Direct by the State: Damian Hauschultz, the defendant's stepson, on who decided how long and who picked the logs 17:56 The State confronts him on who was in charge out in the snow, and what he says he did there 35:06 The two phone calls to the guardian, the wait for him to get home, and why no one called 911 58:57 Cross by the defense after lunch: who picked the logs, the breaks between laps, and going slow 1:10:34 The defense builds its case on what the guardian told him to do, and what he never told him to do 1:29:48 Redirect by the prosecutor: who had the final say on the logs, and what he was told to watch 1:42:33 Recross, a second redirect and a second recross: the fight over one word from the second phone call 1:45:28 Who did this witness help: my read on the five-stop scale CASE BACKGROUND REPORT: https://justiceisaprocess.com/wi-v-ti...
