Lindsay Clancy is back in a Massachusetts courtroom Monday, Nov. 2, for a critical motions hearing that could determine whether she faces a second trial in the deaths of her three young children.
Clancy's first trial ended in a mistrial in September after jurors deadlocked 11-1, with 11 jurors reportedly favoring a finding that she was not criminally responsible for killing her children, Cora, 5, Dawson, 3, and Callan, 8 months, in January 2023.
Now, Clancy's defense attorneys are asking Judge William Sullivan to dismiss the murder charges, arguing that a retrial would violate her constitutional protection against double jeopardy.
The defense contends Sullivan improperly declared a mistrial without adequately investigating allegations that the lone holdout juror refused to follow the law on reasonable doubt. Prosecutors maintain the judge acted appropriately and that a second trial is legally permissible.
Monday's hearing is expected to address several key issues:
Motion to dismiss: Should the murder charges be dismissed because the mistrial was allegedly declared improperly?
Holdout juror investigation: Should the court allow further examination of the lone dissenting juror's conduct, background and jury-selection records?
Proposed gag order: Should attorneys and law enforcement be restricted from publicly discussing the case ahead of a potential retrial?
Potential retrial: Will prosecutors pursue another trial, and when could it begin?
Clancy's defense maintains she was suffering from postpartum psychosis when she killed her children and was not criminally responsible for their deaths. Prosecutors argue she acted deliberately and understood that her actions were wrong.
Plymouth County District Attorney Timothy Cruz has not publicly announced whether his office will pursue another trial or seek lesser charges.
Watch live as Judge Sullivan hears arguments that could shape the future of one of the nation's most closely watched murder cases.
