According to the Court's statement, unprogrammed appropriations are not unconstitutional per se as long as they comply with specific conditions, but Congress violated the Constitution when it increased the total appropriations submitted by the President. Under the doctrine of operative fact, irreversible good-faith programs under the 2024 and 2025 GAAs remain valid, while a 2026 special provision was struck down. Ting said the case did not determine individual liability, any case must be filed before the proper tribunal, and the decision is not yet final and executory.
