⚖️ Can the police complete an investigation and file a charge sheet while a “no coercive action” interim order is in force?
The Supreme Court has clarified this important issue in Arunkumar Mandal v. State of Jharkhand.
In this video, we explain what happens when a High Court or Sessions Court grants interim protection in an anticipatory bail matter with a direction such as “no coercive steps” or “do not harass the accused.”
📌 The Supreme Court clarified:
🔹 Police can continue the investigation.
🔹 They can collect evidence and question the accused as required.
🔹 The accused may be required to cooperate with the investigation.
🔹 Police can complete the investigation and file the charge sheet/final report.
🔹 The “no coercive action” protection primarily protects the person's liberty from arrest; it does not stop the investigation itself.
The judgment also becomes important in light of an earlier Supreme Court matter, Satish Kumar Ravi v. State of Jharkhand, where contempt proceedings had been initiated over the filing of a charge sheet while a similar interim protection order was in force.
⚖️ The key distinction:
Protection from arrest ≠ protection from investigation.
Watch the complete video to understand how anticipatory bail, police investigation and filing of the final report operate together.
