In his opinion on the challenge to the 2023 law governing Election Commission appointments, Justice Dipankar Datta raised pointed questions on the Collegium system, executive involvement and the selective implementation of judicial recommendations.
Justice Datta while questioning ECI's independence also said the judiciary appears to have been “relegated to playing second fiddle” to the executive.
