The United States Treasury can automatically protect two months of qualifying federal benefit deposits when an ordinary creditor sends a garnishment order to a bank. But that protection is not the same as your full account balance. Harold’s example shows how $4,200 in direct Social Security deposits can remain protected while $11,000 of extra savings in the same account can move toward a court judgment.
This episode separates several rules seniors often blend together. SSI has a $2,000 individual and $3,000 couple resource limit that is checked at the start of the month. Bank interest can change the tax calculation for Social Security. A bank offset clause can let a lender apply deposits to its own overdue loan. Medicare IRMAA, inactive accounts, and FDIC coverage after a bank merger each use a different trigger.
The practical number is not one universal maximum after age 65. It depends on your benefit type, two months of qualifying direct deposits, your bills, your loan bank, your SSI status, your interest income, and your FDIC ownership category. The safest review is to calculate your two-month protected benchmark, keep notices and statements, check resource and tax thresholds before moving money, and get legal help immediately if an account is already frozen.
⚠️ Important Note: This video is for educational purposes only. Bank garnishment, SSI resources, Social Security taxation, bank offset, Medicare IRMAA, FDIC insurance, unclaimed-property rules, creditor judgments, and exemption deadlines depend on your accounts, benefit type, state law, contracts, income, notices, and current rules. Verify your own situation with your bank, Social Security, FDIC, tax professional, legal aid, or a qualified attorney.
