A Southwest passenger was removed from his flight before departure after the crew said he was intoxicated. Officers arrived to escort him out of the secure area. He argued, cursed in front of families, and asked whether he was being detained. The answer was that he was being kicked out, the opposite of detained. Seconds later, after he turned back toward officers, he was taken to the floor and arrested. When he asked under what law, an officer answered, "every law." He was charged with disorderly conduct and resisting an officer without violence.
This breakdown examines 14 C.F.R. § 121.575, Florida Statutes §§ 856.011, 877.03, and 843.02, State v. Saunders, and City of Houston v. Hill.
Is being drunk in public a crime in Florida? When does cursing become disorderly conduct? What turns an escort into resisting an officer?
