Generally, while considering a petition for quashing an FIR or charge sheet, the High Court examines whether the allegations, taken at face value, disclose a prima facie offence. It ordinarily does not evaluate the accused's defence or decide disputed questions of fact at this stage.
But is this rule absolute?
Can the High Court, in exceptional circumstances, look beyond the prosecution's case and consider defence material to quash criminal proceedings even before the trial begins?
In this video, we discuss the important legal principle explained by the Supreme Court in Rahul v. State of Uttar Pradesh and Another, with reference to the four-step test laid down in Rajiv Thapar v. Madan Lal Kapoor (2013).
