In this episode, Jennifer Carroll discusses the extent to which a discovery order might be challenged during an appeal and how a Petition for Certiorari might be used.
If you’re being directed by the trial court to produce documents or other materials pertaining to the case but you disagree with either providing the documents themselves or the form In which they are sought, you may have certain remedies.
The trial judge has considerable discretion over these pre-trial issues.
Most of the time you can’t do anything about it. But there are certain situations in which you can file an extraordinary writ if the circumstances warrant it. For instance, you’ve been ordered to disclose trade secrets or attorney-client documents. If compliance would cause irreparable harm, remedies may be available.
Jennifer Carroll discusses these situations and more in this episode.
