Day 4 was the physical evidence and the pathologist. What was never collected, what the jury heard on a detective's phone, and a horseshoe shape that is not in her 2017 injury findings. The uncle on trial is David Prevatte. Paitin Fields was five years old when she died in November 2017 in Pender County, North Carolina. David, her uncle, was named a suspect in 2018 and arrested in February 2022, and he is charged in her death, along with other charges. He is presumed innocent. The State gave notice in February that it will not seek the death penalty (StarNews). These are the five moments from Day 4 a viewer who missed the day needs to see, in the order court happened. The thread through all five: how the physical case was built, and when. The crime scene investigator concedes what was never collected. The State's pathologist explains how photographs of a pair of red earbuds first reached her years after the autopsy. Hold one question the whole way through: if her link to the earbuds began as an opinion formed from pictures, what does the jury have to test it against? And with her photographs kept off the broadcast, the public gets her words, not the pictures behind them. --- KEY MOMENTS 0:00 What this video is, and a preview 0:19 Intro 1:19 Video starts: Top Moment 1. The defense cross of Lt. Daniel Wells, who processed the scene. The State lab testing was for DNA, no standard suspect kit was collected from David, Wells never asked him whether he had showered, and the hospital disposed of evidence before deputies could pick it up. It earned its place because the defense put these gaps in front of the jury in the State's own investigator's words. 9:04 Top Moment 2. Det. Sgt. Roy Brandenburg describes the swab he took from David on November 14, 2017, with David's consent, then jurors hear the recording from his department phone. It made the five because it puts David's consent on the record, on a recording the State chose to play for the jury, made the day after Paitin was found. 24:06 Top Moment 3. Dr. Karen L. Kelly, the forensic pathologist, tells jurors what she saw and the opinion she formed, and says an illness did not cause what she found. Then the judge orders her photographs kept off the broadcast. It made the five because it is the State's medical case in her words, and the moment the public loses sight of the evidence the jury keeps. 35:06 Top Moment 4. How the earbuds reached her. She says Det. Eric Short contacted her, she believes years later, and she was first sent only pictures of a pair of red earbuds. It made the five because when and how an expert's opinion formed is exactly what a jury is allowed to weigh. 43:05 Top Moment 5. The defense cross. The defense has her read her 2017 injury findings aloud, and she agrees she did not note the horseshoe shape there. It made the five because it puts her 2017 report beside her testimony now. Watch her answer and decide what it means. CASE BACKGROUND REPORT: https://justiceisaprocess.com/nc-v-da...
