The Office of the President of Kenya has issued an urgent statement clarifying the government’s position on foreign nationals involved in small-scale businesses following days of uncertainty, fear and regional debate. The controversy began after President William Ruto said small-scale businesses operated by foreign nationals without the required permits should be closed. His remarks caused widespread concern, particularly among Burundians living and working in Kenya. Hundreds subsequently gathered at the Burundi Embassy in Nairobi, with some seeking travel documents or assistance to regularise their status. The Kenyan Government later announced that undocumented East African Community nationals would be allowed to register and obtain the appropriate documentation. That clarification prompted a tense Citizen TV interview in which journalist Sam Gituku questioned Government Spokesperson Charles Owino about the apparent difference between the President’s initial remarks and the registration programme. The latest statement, issued on September 8, 2026, by State House Spokesperson Hussein Mohamed, now provides a more detailed official position. According to the statement, Kenya will protect economic opportunities reserved for its citizens, particularly in the micro and small-enterprise sector. At the same time, the government says it will safeguard the rights and legitimate interests of foreign nationals who legally reside, work, invest or conduct business in the country. The government has announced a 90-day regularisation period. During this window, affected individuals will be assisted in bringing their immigration status, work permits, business registrations and operating licences into compliance with Kenyan law. Relevant government agencies will coordinate the process in consultation with the embassies concerned. The State House has also warned that no individual or group has the authority to harass, intimidate, threaten or interfere with foreign nationals or their businesses. Anyone engaging in such conduct could face legal action.
