Misclassification of non-exempt employees is a common problem in the workplace. Employers may either “inflate” a job title, make a mistake, or sometimes intentionally misclassify employees to avoid having to pay overtime. Most jobs are governed by the FLSA (Fair Labor Standards Act). Some are not. Some jobs are excluded from FLSA coverage by statute.
