In a significant judgment, the Supreme Court has reiterated that High Courts retain their powers under Section 482 CrPC to quash an FIR even after the filing of a charge sheet under Section 173(2) CrPC. A Bench comprising Justice Dipankar Datta and Justice Ujjal Bhuyan observed that if the FIR and charge sheet, taken at face value, do not disclose the commission of any offence, or if the continuation of criminal proceedings would amount to an abuse of the process of law, the High Court can exercise its inherent jurisdiction to quash the proceedings. The Court quashed the FIR and charge sheet against the husband and parents-in-law in a case registered under Section 498A IPC and set aside the Gujarat High Court's refusal to grant relief.
