2026 Summer Webinar Series: Outpatient Conditional Release, Monitoring, and Public Safety

The court's jurisdiction over a person acquitted by reason of insanity does not end with inpatient discharge. The legal, clinical, and supervisory framework that governs conditional release is among the least-understood areas of Texas mental health law. This webinar brings together a judge, a prosecutor, a defense attorney, a chief probation officer, and community treatment providers to examine the full architecture of post-release oversight from every stakeholder's vantage point. Topics include the scope and limits of ongoing court jurisdiction, the structure and conditions of conditional release, review hearing standards and procedures, the legal and clinical thresholds that govern revocation, and the interagency coordination required among courts, LMHAs, probation, and treatment providers to make community supervision work. Presenters will also address victim notification requirements, the enduring tension between individual liberty and public safety in this context, and the practical supervision challenges that arise in a system where treatment resources vary widely across the state. Where available, data and outcomes on conditional release populations will be presented to ground the discussion in evidence and inform future policy.
