How to Read & Properly Understand the FMGL Regulations, 2021 Gazette Notification Yourself - Don’t Rely on Misinterpretations
The National Medical Commission (Foreign Medical Graduate Licentiate) Regulations, 2021 should be understood by reading the Gazette Notification carefully, systematically and as a whole—not through assumptions, selective reading, isolated clauses or convenient interpretations.
Since the introduction of the FMGL Regulations, 2021, there have been several questions and differing interpretations regarding course duration, internship, mandatory subjects, registration and licensing requirements.
In this video, I try to explain the Regulations in simple language by reading the relevant provisions together with Schedule-I, because individual clauses should not be interpreted in isolation.
Important Points Discussed in This Video:
✅ 1. Minimum 54-Month Course Requirement
Section 4(a)(i) provides for a foreign medical degree course with a minimum duration of 54 months.
However, the 54-month provision should be understood as a minimum threshold for the foreign medical degree course. It should be read together with Schedule-I, which describes the course as including theory, practical and clinical training.
A longer course duration does not automatically mean that it must be reduced to 54 months.
✅ 2. The 12-Month Internship Requirement
Section 4(a)(ii) should be read together with Schedule-I, Paragraph 2(i)(b).
Schedule-I states that the required internship of 12 months is to be completed in addition to the course and in the same foreign institution where the primary medical qualification is obtained.
This distinction between the medical course and the separately required internship is an important aspect that needs to be properly understood.
✅ 3. English as the Medium of Instruction
The Regulations require that the foreign medical degree should have been completed with the medium of instruction in English.
✅ 4. Mandatory Subjects and Curriculum
Section 4(a)(iv) should be read together with Schedule-I.
The course and training must include the required subjects and should be commensurate with the applicable requirements relating to the MBBS course in India.
The curriculum should also be available for review by the appropriate authorities.
✅ 5. Registration & Licensing — Section 4(b)
One of the most important provisions of the FMGL Regulations relates to registration or licensing to practice medicine.
Section 4(b) requires the graduate to be registered with the respective professional regulatory body, or otherwise be competent to obtain a license to practice medicine in the country where the medical degree is awarded, at par with the license available to citizens of that country.
The exact registration and licensing procedure may differ from country to country. Therefore, students must carefully understand the legal and regulatory system of the country where they plan to study.
✅ 6. The Entire Course Must Be Completed Abroad
Schedule-I also provides that the entire course, training and internship/clerkship should be completed outside India in the same foreign medical institution, subject to the requirements specified in the Regulations.
✅ 7. The 10-Year Maximum Period
The total duration of the foreign medical graduation course must be completed within 10 years from the date of joining the course.
