Can an Agreement to Sell make you the legal owner of a property? What is the time limit for filing a court case to enforce the agreement? In this video, we explain the legal position regarding an Agreement to Sell, a Suit for Specific Performance, Title Suits, and the limitation period under Article 54 of the Limitation Act, 1963.
An Agreement to Sell does not, by itself, transfer ownership of immovable property. If the seller refuses to execute the sale deed, the buyer may file a Suit for Specific Performance and seek a court decree directing the seller to complete the transaction. Under Article 54 of the Limitation Act, 1963, the limitation period is generally three years from the date fixed for performance or, if no date is fixed, from when the buyer has notice that performance is refused. After obtaining the necessary decree, the buyer must follow the legal process for completing the transfer and establishing ownership. The exact remedy depends on the facts and documents of the case.
