*The Supreme Court was asked NOT to issue notice to the Lok Sabha Speaker.* And the Court didn’t. But on the very same day, in the same case, it issued notice to *20 MPs* accused of defecting from the TMC. That distinction is at the heart of today’s hearing. The petition, filed by *Abhishek Banerjee**, challenges the delay in deciding disqualification petitions against the 20 MPs. The question before the Court is not simply whether notices have been issued — it is **when the proceedings will actually be concluded.* Justice Joymalya Bagchi put it sharply: *“It is a question of concluding the proceedings within a time frame.”* The numbers make the case even more significant. TMC had *29 Lok Sabha MPs from West Bengal**. Twenty are now sitting with another party and supporting the NDA, leaving TMC with just **9 MPs* from the state. The legal defence? *Merger.* Under the Tenth Schedule, a merger can avoid disqualification if the constitutionally required *two-thirds* threshold is met. And 20 out of 29 is just above that threshold. But TMC argues that the merger must involve the **political party itself**, not merely a group of legislators. And there’s another crucial issue: *time.* The Supreme Court has previously said that Speakers should ordinarily decide defection petitions within a reasonable timeframe, with three months being the general benchmark in *Keisham Meghachandra*. So today’s real question may not be about *notice* at all. It may be about the **clock**. Because if a disqualification decision comes years later, after MPs have already completed most of their term, what practical difference does that decision make?
