SPECIAL RULE OF CROSS EXAMINATION FOR SECOND 164 CRPC 183 BNSS STATEMENT CRIMINAL CASE IPC BNS Intro: Earlier 164 CrPC and now 183 BNSS are provisions for recording confessions of Accused or statements of Prosecution witnesses before a magistrate. The statements of Prosecution Witnesses recorded before a Magistrate have a credential attached to them. It is presumed that while making a statement before Magistrate, the witness is free from fear and any outside influence on it. Generally, such Statement before Magistrate is recorded once in the investigation of Criminal Case. These statements before a Magistrate by the victims of offences related their modesty and womanhood attach a great credibility to their version of offence. And now in case of incapability of the prosecutrices to depose orally before the Court, these statements under 164 CrPC or 183 BNSS would be considered as their Court testimony and the Defence Counsel will be asked to cross the victim on that statement.
