Labastida v. Quires | G.R. No. 251903 | January 27, 2025 | Right to Appeal and Proof of Service Can your right to appeal be lost because of a letter you never received? In this case, the Supreme Court reversed the dismissal of Victoria M. Labastida’s administrative appeal, ruling that the registry return receipt alone was insufficient to establish proper service of the decision dismissing her from government service. The Court held that the period to appeal must be reckoned from adequately proven service. The presumption of regularity in official duties and receipt of mailed documents may be overcome by contrary evidence. TLG LEGAL INSIGHT: An appeal cannot be declared late based on an unsupported assumption of service. Before a party loses the right to appeal, the date of service must be established in accordance with the applicable procedural rules.
