Tough Call sequel: Lance needs $15,940 to go away before December 9 at nine, and only you can say yes. Make the call → https://toughcall.beehiiv.com/p/he-sa...
In this fictional POV story, the manager of an old Columbus steakhouse picks up the Happy 25th card a server left on the window booth and drops it on a two-top by the kitchen door. "Anniversary people," he says. He has no idea you own the restaurant, and twenty-one more, including his job.
Through that swinging door you hear him tell a server to ring his friends' free dinners on her number, every Thursday, each comp under the limit. At nine the district director arrives to sign her firing. You have the printed check and one way to clear her name that nobody can argue with, and it costs you the one thing that lets you see your restaurants as they really are.

Story figures:
All figures are fictional. Lindell Restaurant Group has 22 restaurants in Ohio, Indiana and Kentucky, about $148 million a year in sales and about 2,400 people, bought in 2021 for $61 million through Whitford Lane Holdings. One unannounced dinner per restaurant per year makes 110 dinners in five years, always at full price with a 25% tip. A manager may comp up to $200 on one check alone. Tonight's check is $1,186, comped in seven lines, none over $200. Kelsey's list shows 61 comps worth $15,940 on her number over 14 Thursdays, almost 7% of her sales against a district average of about 1%. The district director runs 8 restaurants, and about 40 people work the kitchen.

Background:
Lindell's Chophouse, Lindell Restaurant Group and Whitford Lane Holdings are invented. General background, not legal advice:
A holding company "owns sufficient voting stock in another corporation to control its policies and management" (Cornell Law School LII, Wex: "holding company", https://www.law.cornell.edu/wex/holdi.... Groups that own many restaurants often sit under one parent like this.
Restaurant point-of-sale systems can be set up to need a manager's approval for voids and comps, and the record shows which employees use them (Dinlr, "Restaurant Employee Theft: How Voids and Comps Can Be Used to Steal", https://www.dinlr.com/us/blog/restaur....
Loss-prevention advice warns that unlimited permissions invite "comp, void, and promo abuse", that managers should log in with a swiped card or fingerprint rather than a PIN staff can memorize, and that shared logins make it "nearly impossible" to trace who did what (SpeedLine Solutions, "How to Reduce Employee Theft in Your Restaurant", https://www.speedlinesolutions.com/bl.... That is why a comp report that lists a server's number does not by itself show who approved the comp.
Restaurant brands use mystery shopping (also called secret shopping) to see the real guest experience across their locations (Market Force, restaurant mystery shopping, https://www.marketforce.com/restauran....
In Ohio, a worker discharged for just cause in connection with the work is not eligible for unemployment benefits for the length of that unemployment (Ohio Rev. Code 4141.29(D)(2)(a), https://codes.ohio.gov/ohio-revised-c.... Whether a firing counts as just cause depends on the facts.
