Thinking of going back to your first course so you can apply for another student visa from inside Australia? Immigration lawyer Nilesh Nandan explains why he thinks the "boomerang enrolment" strategy doesn't have legs under the new rules, and what can happen if you lodge anyway.
On 1 October 2026 the Assistant Minister signed LIN 26/087, amending LIN 20/158, which sets out who can make a further student visa (subclass 500) application in Australia. In this session Nilesh works through a real question: a student who finished one master's course with one provider, moved to a different master's course with a second provider, and was told to re-enrol in the first course to fit the completion of studies exemption.
What you will learn:
How the completion of studies exemption works, and the 12 month limit in paragraphs (d) and (e)
Why "the" confirmation of enrolment matters, and why a new CoE is not the original one
Why the application could be invalid, not just refused (a Schedule 1 requirement)
The genuine student risk if your course history looks like a big change of direction
What to ask your education provider before you spend money on an application
