What does the Code of Muslim Personal Laws PD 1083 say about paternity, legitimacy, and support? In this video, we explain TITLE III on Paternity and Filiation. We discuss how a child becomes legitimate through valid marriage at the time of conception, the legal presumptions under Article 59, rules for children born during marriage or after dissolution, and procedures for pregnancy after divorce including court measures to prevent simulation of birth. We also cover the rights of legitimate children: the right to bear both parents’ surnames, the right to receive support, and the right to inherit under the Code. Learn how paternity can be established through the father's acknowledgment or _iqra_, the conditions required for it to be valid, and why adoption does not confer the status of a legitimate child under Muslim law though gifts are permitted. Lastly, we break down TITLE IV on Nafaqa or Support.
