Day 7 of the Faith Hedgepeth murder trial: the five moments that mattered, in court order. One witness held the stand all day, Erin Ermish, the State Crime Lab DNA analyst. The defendant is presumed innocent. I am not the jury, and only the jurors decide.
0:00 What this video is, and a preview
0:18 Video starts: TOP MOMENT 1: 170 septillion times more likely
Her lab never says a profile belongs to one person; it weighs two hypotheses, and she reaches for a seesaw, an ant against an elephant. Her result for one swab taken from Faith: about 170 septillion times more likely if it came from Faith and the defendant than from Faith and one unknown, unrelated person. A one followed by 26 zeros. Why it made the five: it is the State's headline number, and the whole cross aims at how it is made.
12:16 TOP MOMENT 2: Why Faith was not on both sides of the Bacardi cap numbers
Defense attorney James Rainsford on cross. The software put 95.49% of the DNA on the cap with the component that best fit Faith, and the cap tested presumptively positive for blood. Why not assume Faith in both hypotheses? Lab procedure: the bottle did not come directly from a person's body. "Yes, it would change the likelihood ratio." The software could run it. It was not run. Why it made the five: the hypotheses are chosen, and the choice moves the number.
22:28 TOP MOMENT 3: What was never swabbed on Faith's phone
Spot by spot on State's Exhibits 127 and 128. The buttons, the back of the purple case, the back of the phone and the paper inside the case: none swabbed. She tested a pen for touch DNA; the paper "potentially" carried it too, and was not sampled. Why it made the five: she was after DNA from whoever handled that phone, and here the jury learns how much went unsampled.
35:05 TOP MOMENT 4: Hairs, pillows, sheets, a comforter
The end of the cross. No hair roots tested. Pillows, bed sheets, the comforter: not tested. A spot on a pair of jean shorts, presumptively positive for blood, was passed over, and nothing prevented testing it. Why it made the five: Top Moment 3 was parts of one item; these are whole items that never reached her bench.
43:43 TOP MOMENT 5: Why the lab stopped, argued with the jury out
On redirect the State asks about a talk with Chapel Hill police over receiving more items. The defense objects on hearsay, confrontation and due process; the jury goes out. "Therefore, the objection respectfully is sustained." The State tries again through her standing as an expert, and the judge allows one narrower question. The jury hears her answer: in 2013 she stopped receiving crime scene items because of the unknown DNA profile found on multiple items. Why it made the five: you see the whole fight the jury never saw, then the answer that survived it.
