One psychologist. One denied witness. And a day that ends with a reason the judge won't give.
Day 16 of the Lindsay Clancy murder trial closes out the defense's psychologist, the expert whose opinion the whole insanity defense turns on: that the Duxbury mother who killed her three children, Cora, Dawson and Callan, was in the grip of postpartum psychosis and could not appreciate what she was doing. The Commonwealth spends the morning picking apart how close he has gotten to her, sixty visits, daily trips to check on her in lockup, a friendship with defense counsel that goes back twenty years, before the defense turns that closeness into the reason to believe him: he cares enough to keep showing up. Then, with the jury gone for the day, a fight over a witness nobody in the room will ever hear from, one who went looking for the spotlight and found her way into a murder trial instead.
The day was supposed to end with a ruling. Instead it ends with the judge sending the jury home until morning for what he calls an unforeseen circumstance, telling them not to speculate and not to hold it against either side. He does not say what happened. Neither do we.
WITNESS & HEARING GUIDE
0:00:00 — Dr. Paul Zeizel, the defense's psychologist — Picking up where Day 15 left off: the expert the defense needs to convince the jury she was too sick to know right from wrong.
0:06:49 — The hotline — December 2022, twice: she calls asking for help and is turned away both times because she doesn't have a plan.
0:23:35 — THE OPINION — Bipolar disorder with postpartum psychosis, no appreciation of the wrongfulness of her act. The defense's entire case, in one answer.
0:37:57 — The cross begins — The Commonwealth doesn't argue the diagnosis. It argues the doctor: a friend of defense counsel for twenty years, sixty visits deep, paid through the state's indigent defense fund.
1:39:19 — "She sought help instead" — Months of hearing voices telling her to hurt herself, and she never once acted on them. The cross ends there.
1:44:32 — Not chained to a van — What the defense had to ask the court just to get her to the courthouse, and why.
1:53:49 — "One other. One other. None." — Four rapid questions on recross expose exactly how close this evaluation got, and how unlike his other cases this one is.
1:56:12 — The last answer — Why he checks on her in the lockup every day, and the concern that "sits directly below the surface."
1:59:29 — Hearing: the McLean witness — The jury is sent out, and the lawyers argue over a witness the jury will never meet.
2:00:40 — Emily Thorndike, a former McLean Hospital social worker — A TikTok video she posted criticizing McLean's care went viral, and the defense's investigator tracked her down. Called outside the jury's presence to describe the unit Lindsay Clancy was on over New Year's.
2:20:48 — The number that survives her — McLean's own staffing records: no social worker on the unit New Year's Day, or the day after, the exact holiday the Commonwealth had painted as fully staffed.
2:39:20 — The ruling — The judge finds her credible and finds no bad faith on either side, then keeps her off the stand anyway under Rule 403. But he lets her records in.
2:43:01 — Court adjourns — For a reason the judge will not name, telling the jury not to speculate and that the trial is still on schedule.
