Lincoln Financial denied long term disability benefits for a Patient Care Coordinator at United Regional Hospital after paying her claim for 24 months, suggesting she could perform other sedentary jobs when she had already proven she could not do her own sedentary job. Our client worked as a Patient Care Coordinator at United Regional Hospital Care, a sedentary position that Lincoln Financial had acknowledged she could not perform for two full years. She suffered from severe osteoarthritis in both knees requiring double knee replacement surgery, osteoarthritis of the shoulder requiring surgery, degenerative disc disease, chronic pain, and depression and anxiety resulting from her physical conditions. She was also taking significant pain medication that caused side effects affecting her ability to function reliably. Social Security approved her disability claim. When the policy definition changed from own occupation to any gainful occupation at 24 months, Lincoln denied continued benefits, claiming she could now perform alternative sedentary jobs such as records reviewer or manager in her field.
The contradiction in Lincoln's denial was immediately apparent: if she could not perform her own sedentary job for two years, how could she suddenly perform a different sedentary job with the same or similar physical demands? Lincoln based this conclusion on peer review doctors who never examined her and never sent her for a Functional Capacity Evaluation or Independent Medical Examination. Her treating physicians, who had been documenting her inability to work for years, were unanimously opposed to the denial.
