Today I'm going to explain something about deeds related to real estate and titles for motor vehicles, and how they are different. This is a common misconception I hear from people who are worried because they've lost the deed to their house. If you've ever lost the title to a vehicle, you know you have to apply for a replacement through the Secretary of State. In Illinois, it can be a bit of a process, but it happens all the time. With a car, the title is your proof of ownership. Real estate works differently. When you buy property, the deed is signed over to you at closing and then recorded with the county clerk and recorder. You typically receive a copy for your records. You should keep your deed in a safe place, like a fireproof safe. However, if you lose it, the original record still exists with the county. Ownership is established through those official land records—not just the paper you hold. Unlike a car title, someone cannot simply take your deed and sell your property. Title companies search public records to confirm ownership and ensure there are no liens or encumbrances before a sale. Your mortgage lender does not hold your deed. Instead, they record a lien against the property. When the property is sold, that lien is identified and paid off during the closing process. The bottom line is: don’t panic if you can’t find your deed. You can obtain a copy from the county recorder’s office, and your ownership is still protected.
