The Uncle on Trial is State of North Carolina v. David Wesley Prevatte in Pender County. Paitin Fields was five years old, sick all weekend with a bad cough, when she was found on the couch at her grandparents' home in November 2017. She died two days later. Her uncle, David Prevatte, had just turned 19. He was named a suspect early, not charged until 2022, and he has pleaded not guilty. On Day 2 the State called its first witness from inside that house: Lisa Hunt, his mother and Paitin's grandmother, testifying for the prosecution in a trial where her son is the defendant and her granddaughter is the victim.
I walk through her testimony with the footage. She let David in around 10 o'clock and believes she locked the door behind him. The girls were asleep on the couch and doing fine. She was woken by her husband going to the restroom, then by a loud TV, and when she went out to turn it down she found Paitin on the couch. That puts David in the house, and nobody was disputing that. Opportunity is not proof of who did this, and nothing she said puts him at the couch.
Then the two questions this jury still cannot answer. Before Lisa Hunt got up, Paitin's seven-year-old sister had already come in and woken her grandfather. Both openings told the jury what that little girl said at three in the morning: that her sister was acting funny. So when did her uncle come into that story? The defense says her account came later, after she moved in with an aunt, and that she was coached against David. Neither side has accused her of doing anything, and I won't either. On Lisa Hunt's account, the only adult who heard that little girl that night is Dale Hunt, which makes him one of the most important witnesses in this trial. And one word from the stand: "Was David dressed?" "Yes." The prosecutor moved straight on. In my opinion that is a suggestion, not evidence, until the State proves it means something. That is my read, not a verdict. David Prevatte is presumed innocent, and the call belongs to the jury.
