Will Gyanesh’ Immunity Go? SC Issues Notice To Centre, EC - Explained| SIR| The Supreme Court has issued notices to the Centre and the Election Commission on pleas that directly challenge the immunity enjoyed by Chief Election Commissioner Gyanesh Kumar under the 2023 law. Petitions before the Court allege that key decisions linked to the Special Intensive Revision (SIR) of electoral rolls were taken unilaterally, despite recorded objections from the other two Election Commissioners. The Bench headed by CJI Surya Kant has made it clear that any decision found not to be in accordance with law can be annulled. At the same time, the Court is examining Section 16 of the CEC Act, which grants serving and former Election Commissioners protection from civil or criminal proceedings for acts done in the discharge of official duties—even after they demit office. This protection is broader than what is available to judges. Combined with questions around Form 6 modifications and the scale of voter-list changes during SIR in multiple states, the case raises a fundamental issue: how much legal shield can an election body claim while remaining accountable to the Constitution and the voter? Watch the full explainer for the key court observations, the ECI’s response so far, and what this means for the ongoing SIR process and the independence of the Election Commission. #GyaneshKumar #SupremeCourt #SIR #ElectionCommission #CECImmunity #ElectoralRolls #IndianPolitics #Democracy #DoubleCheck #VoterRights #Article324 #CECAct2023 #BreakingNews #IndiaNews #PressFreedom
