Can a husband avoid paying maintenance to his ex wife because he is physically disabled? And what happens when the husband claims that he married the woman only because he wanted someone to take care of him and his mother?
In this important case, the Kerala High Court upheld an order directing a husband to pay ₹10,000 per month as maintenance to his ex wife.
The husband had suffered a paralytic stroke and claimed around 70% permanent locomotor disability. He argued that his physical condition affected his ability to work and that the marriage had never been consummated.
His defence also included the unusual claim that the matrimonial advertisement was placed essentially to find someone who could take care of him and his mother.
The Kerala High Court, however, rejected the challenge to the maintenance order. The Court examined the overall financial circumstances of the parties, the wife’s inability to maintain herself and the evidence concerning the husband’s financial capacity.
The Court also strongly criticised the husband’s explanation regarding the purpose of the marriage and observed that he could not use such conduct to escape his responsibility towards the wife.
But there is an important legal point: this judgment does not mean that every disabled husband must automatically pay maintenance, nor does disability itself become irrelevant. Maintenance depends on the facts and circumstances of each case, including the parties’ financial position, the wife’s means and the evidence available before the Court.
In this video, Adv. Vaibhav M. Agrawal explains the case in extremely simple language and discusses what the Kerala High Court actually held, why the ₹10,000 monthly maintenance was upheld, how disability was considered and what the judgment means for maintenance law in India.
