The VCR: The Machine That Took Hollywood to the Supreme Court

The VCR didn’t just change how Americans watched television—it triggered a copyright battle so serious that Hollywood took the technology all the way to the U.S. Supreme Court. In the 1970s, Sony’s Betamax allowed ordinary viewers to record television programs at home and watch them later, a practice that became known as “time-shifting.” Universal City Studios and Walt Disney Productions argued that consumers were copying copyrighted programs and that Sony should be held responsible for making the technology possible. The legal battle eventually became Sony Corp. of America v. Universal City Studios, one of the most important technology and copyright cases of the 20th century. In 1984, the Supreme Court ruled 5–4 in Sony’s favor. The Court concluded that manufacturers could not be held liable simply because their technology was capable of infringement when that technology also had substantial legitimate uses. It also found that private, noncommercial recording of television for later viewing could qualify as fair use under the circumstances of the case. In this video, we explore why Hollywood was so afraid of home video recording, how the VCR threatened the traditional television and movie business, and how one machine helped establish a legal principle that would become enormously important as new technologies arrived. A simple box under the television ended up forcing the Supreme Court to answer a much bigger question: How much control should copyright owners have over new technology?
