*Karnataka High Court | Justice M. Nagaprasanna | Court Hall 19*
In a significant development in a 498A dowry harassment case, the Karnataka High Court, presided over by Justice M. Nagaprasanna, heard a petition seeking to quash criminal proceedings under IPC Sections 498A and 149, along with Sections 3 and 4 of the Dowry Prohibition Act.
During the hearing, the husband's counsel argued that the allegations were contradictory, pointing out inconsistencies between the legal notice and the subsequent FIR. The counsel also argued that the parents-in-law had been implicated through vague and general allegations without specific evidence.
The complainant's counsel opposed the petition, arguing that the wife had faced physical and mental cruelty, including an alleged assault during pregnancy, and that the allegations required a full trial.
*COURT'S DECISION:*
The High Court quashed the criminal proceedings against the mother-in-law and father-in-law, observing that there was no specific material supporting the allegations against them.
However, the proceedings against the husband were not quashed at this stage.
The husband was given liberty to approach the trial court and seek discharge in accordance with law.
The court also referred to the Supreme Court judgment in Kahkashan Kausar v. State of Bihar concerning vague and omnibus allegations against relatives in matrimonial disputes.
