A tense and emotional sentencing hearing unfolds in State of Ohio v. Jed S. Hupp.
The defendant pleaded guilty to four counts of gross sexual imposition, all third-degree felonies. During sentencing, the defense presented arguments about the defendant's upbringing, family circumstances, substance abuse, and lack of parental guidance.
But the judge strongly rejected the suggestion that the victim or her mother could bear responsibility for what happened.
The judge called the defense argument “nothing short of outrageous” and emphasized that the defendant was an adult while the victim was a child.
The victim impact statement was also read in court, describing the severe emotional and psychological consequences she says she experienced.
The judge then focused on the defendant's prepared statement, pointing out that he talked extensively about improving himself but never mentioned the victim.
The final sentence was severe: 60 months on each of four counts, served consecutively, for a total of 240 months—or 20 years in prison.
The defendant also received 28 days of jail-time credit and will be subject to 5 years of mandatory post-release control.
