Charged with disqualified driving in Queensland? A conviction means another 2 to 5 years off the road, no work licence, and a real risk of jail. But a charge isn't a conviction.
Queensland traffic lawyer Steven Brough, founder of Driving Law, explains the defences to a disqualified driving charge and when they work:
• Not on a road: when a car park counts, and why being asleep in a parked car isn't driving
• Not the driver: what police must prove when the evidence is a camera, a video or rego
• Sudden or extraordinary emergency: including a real case where the charge was withdrawn
• Disqualification not validly in force: orders and periods that were wrongly recorded
• Two things that aren't defences: thinking your disqualification had ended, and lodging an appeal
• How charges can be reduced to driving while suspended or ordinary unlicensed driving
