UK ILR & SETTLEMENT UPDATE 2026 — IMPORTANT CHANGES EXPLAINED Are you currently on a 5-year route to ILR, or are you worried that settlement could become 10 years? In this video, we explain what has actually changed, what is still proposed, and what applicants need to prepare for. The government’s Earned Settlement proposals envisage a 10-year baseline for most migrants, with the possibility of reducing or increasing the qualifying period depending on circumstances. However, these wider changes should not be described as already applying to everyone: the government has consulted on transitional arrangements for people already on a settlement pathway, and the final treatment depends on the Immigration Rules implementing the new system. GOV.UK We also explain what this could mean for people already progressing toward ILR on a 5-year route, as well as existing 10-year routes and the proposed Earned Settlement system. Current Home Office guidance still identifies both 5-year and 10-year family settlement routes. GOV.UK What about refugees? Under the rules currently published on GOV.UK, a person with qualifying refugee/protection status can currently apply for settlement after 5 years. Separately, the government’s proposed future Earned Settlement model sets out a 20-year starting point for refugees, with possible reductions in specified circumstances. That 20-year figure is therefore important to describe in the video as a proposal for the future system, rather than the current refugee ILR rule. GOV.UK There is also a confirmed English-language change for settlement. For a number of affected routes, the requirement will increase from B1 to B2 from 26 March 2027, subject to exemptions. The Home Office specifically says this change will apply to people already on a pathway to settlement on the affected routes.
