Al Capone wasn't convicted of murder or bootlegging. In October 1931 a federal jury in Chicago convicted him of income tax evasion, and Judge James H. Wilkerson sentenced him to 11 years. The case turned on paper: a cloth-bound book of gambling profits seized by Cicero police in 1926, filed away in a federal office and found by Treasury agent Frank J. Wilson four years later. This video follows the case through the record: the 1927 Supreme Court ruling in United States v. Sullivan that illegal income is taxable; the spending trail (shirts, a Lincoln bought as "Al Brown", a Palm Island house); the handwriting that pointed to cashier Leslie Shumway and his sworn statement; the plea deal Judge Wilkerson refused; the jury panel swapped on the first day of trial; the evidence the jury actually heard (the book, spending witnesses, cashier's checks and his own tax lawyer's letter); the verdict on 5 of 23 counts, including acquittal on the 1924 charge; Atlanta and Alcatraz; and how Eliot Ness and "The Untouchables" fit the real story. Documents shown: Special Agent Frank J. Wilson's report "In re: Alphonse Capone," Treasury Intelligence Unit, Dec. 21, 1933 (IRS FOIA release); United States v. Sullivan, 274 U.S. 259 (1927); Capone v. United States, 56 F.2d 927 (7th Cir. 1932); Bureau of Investigation identification record with Atlanta penitentiary mugshots (1932).
